Terms of service

By accessing our website, purchasing our products, creating an account, subscribing, or otherwise using Loomi services (together, Services), you agree to these Terms. If you do not agree, please do not use the Services.
These Terms sit alongside our Privacy Policy, Shipping Policy, Returns & Refunds Policy, and any promotion-specific terms. Nothing in these Terms limits your rights under the Australian Consumer Law (ACL).
1) Eligibility and key definitions

You/Customer: the person who accesses the site or purchases. You must be 18+ to purchase.

We/Us: Loomi

Products: GLOW gummies and any other goods we offer.

Site: pages at loomigummies.com and sub-domains.

Business days: Monday–Friday, excluding public holidays in NSW.
2) Changes to these Terms
We may update these Terms at any time by posting a new version on the Site. The version in force when you place an order governs that order. Material changes will be highlighted on-site.
3) Health & safety disclaimer

GLOW is a food supplement/beauty supplement. It is not a medicine, sunscreen, or therapeutic good, and is not intended to diagnose, treat, cure or prevent any disease.

Follow the label directions. Keep out of reach of children. Do not use if tamper seal is broken. Store below 25 °C, away from direct sunlight.

If you are pregnant or breastfeeding, managing vitamin A intake, taking medication, smoke or recently quit, or have a medical condition, consult your healthcare professional before use.

Discontinue use and seek advice if you experience any adverse reaction.

Use of the Site and Products is at your own risk, subject always to your rights under the ACL.
4) Account, communications, and privacy

You may shop as a guest or create an account. You are responsible for keeping your login secure and for activity on your account.

By ordering, you consent to receive transactional emails (order confirmations, shipping updates, service notices).

Marketing emails/SMS are sent only with your consent; you can opt out at any time (unsubscribe link or reply STOP for SMS).

We handle personal information under our Privacy Policy (Privacy Act 1988 (Cth) and Spam Act 2003 (Cth)).
5) Orders, availability, and pricing

Submitting an order is an offer to buy. We may accept or refuse at our discretion (for example, suspected fraud, address issues, out-of-stock).

Prices are shown in your selected currency where offered and include GST for Australian orders. Shipping, duties, and taxes (for international orders) are shown at checkout.

We take care with pricing and availability but errors can occur. If we discover an error, we’ll contact you; you may proceed at the corrected price or cancel for a full refund.

Images are for illustration; packaging and labelling may vary without changing the product quality or specification.
6) Payment
We accept the payment methods displayed at checkout (e.g., cards, digital wallets, BNPL). You authorise us (and our payment processor) to charge your chosen method for your order total, including shipping and taxes. If your payment fails, the order may be cancelled.
7) Subscriptions and auto-renewals

If you start a subscription, you authorise recurring charges at the interval shown at checkout until you cancel.

You can pause, edit, or cancel any time before your next charge date via your account portal. If a renewal has been charged and processed, that shipment will proceed and changes apply to the next cycle.
8) Shipping, risk, and delivery issues

We ship to Australia, New Zealand, the United Kingdom, and the United States (see Shipping Policy and Returns & Refunds Policy for details).

Orders are typically packed in 1–2 business days. Timeframes shown at checkout are estimates only.

Once handed to the carrier, transit delays, missed scans, strikes, extreme weather, customs, and other events are outside our control. We’ll help chase things up, but we’re not responsible for carrier delays (ACL rights preserved).

Please provide an accurate delivery address. If a parcel returns due to an incorrect or incomplete address, we can reship once received; a reship fee may apply.

If you select Authority to Leave, risk passes when the carrier marks delivered. Sign-on delivery passes risk at signature.
9) Returns, refunds, exchanges
Please read our Shipping Policy and Returns & Refunds Policy. In short:

Change of mind: unopened, sealed product within 30 days of delivery, at your cost to return (resaleable condition).

Faulty or not of acceptable quality: we will repair, replace, or refund in line with the ACL; we cover return postage where a return is required.

Exclusions: opened consumables (change of mind), gift cards, free gifts/samples, clearly marked final-sale items.

Refunds are processed to your original payment method once approved.
10) 12-Week Glow Guarantee (brand promise)
The 12-Week Glow Guarantee is our satisfaction promise in addition to your ACL rights. Key points:

Applies to the product price of your first jar purchased from our website, one claim per customer/household.

Complete a fair trial: generally two gummies daily with food for 12 weeks (we allow up to seven missed days); for photo assessment, avoid surface colour for 48 hours prior.
-
Submit your claim within 14 days of completing week 12 with Week 0 and Week 12 photos in natural light (same framing), your order number, and a short usage note.
-
We refund the product price to your original payment method. Shipping/duties/taxes are excluded under this brand promise.
-
We may refuse claims made in bad faith or that don’t meet the published criteria. Your ACL rights remain unaffected.

11) Promotions, gifts, and referrals

Promotional codes, discounts, gifts with purchase, and bundles are subject to their own terms and valid for a limited time.

Unless stated, promotions cannot be combined and are not transferable or redeemable for cash.

If you return items that qualified you for a gift/discount, your refund may be reduced by the value of that benefit if it is not also returned (subject to ACL).
12) Product information and results

We aim for accurate ingredient lists, nutrition panels, and directions; always check your product’s label.

Individual responses to supplements vary. Timelines and outcomes mentioned on the Site are general information only and not guarantees of results.
13) User content (reviews, photos, social tags)

If you submit reviews, testimonials, photos, videos, or tag us on social media with our handle or campaign hashtags, you grant Loomi a non-exclusive, royalty-free, worldwide licence to use, reproduce, edit, share, and display that content in connection with our business (including on the Site, ads, socials, and emails), with attribution where practicable.

You warrant you own or control the rights in the content and that it does not infringe others’ rights or contain unlawful, defamatory, misleading, or offensive material. We may remove or decline to publish content at our discretion.
14) Acceptable use
You must not misuse the Site or Services, including by:

attempting to access accounts or data not intended for you;
-
introducing malware, scraping or mining without consent, or overloading our infrastructure;
-
using automated means to place bulk orders without permission;
-
using the Site for unlawful purposes or to infringe IP or privacy rights.
15) Intellectual property
All content on the Site (including text, graphics, logos, product names, photographs, video, and code) is owned by or licensed to Loomi and is protected by IP laws. You may not copy, modify, distribute, or create derivative works without our prior written consent. “Loomi” and “GLOW” are trade marks of Loomi (registered or pending).
16) Third-party services and links
The Site may link to third-party sites or use third-party services (payments, shipping, analytics). We are not responsible for their content or practices. Your use of those services may be subject to their terms and privacy policies.
17) Pre-orders and backorders
Pre-orders are charged at checkout. Estimated ship dates are indicative and may change due to manufacturing or logistics. You may cancel a pre-order for a full refund any time before shipment by emailing support@[yourdomain].com.
18) Force majeure
We are not liable for delay or failure to perform due to events beyond our reasonable control, including natural disasters, pandemics, strikes, carrier disruption, war, government action, or utility failures. Your ACL rights still apply.
19) Warranties, liability, and ACL

Except for the non-excludable guarantees under the ACL, we provide the Site and Products “as is” and make no other warranties.

To the maximum extent permitted by law, our liability for breach of a consumer guarantee is limited (at our option) to replacement of the goods, supply of equivalent goods, repair of the goods, or payment of the cost of doing so.

We do not exclude liability for loss that cannot be excluded under the ACL.

Subject to the ACL, we are not liable for indirect or consequential loss, loss of profits, or loss from delays outside our control.
Nothing in this clause limits your rights under the ACL.
20) Indemnity
To the extent permitted by law, you indemnify us from loss, damage, claims, and expenses arising from your breach of these Terms, unlawful acts, or misuse of the Services. This does not apply to loss caused by our negligence or breach of the ACL.
21) Governing law and disputes
These Terms are governed by the laws of New South Wales, Australia. If a dispute arises, please contact us first at support@loomigummies.com. If we cannot resolve it, the courts of New South Wales have non-exclusive jurisdiction. Your statutory rights remain.
22) Severability and assignment
If any part of these Terms is unenforceable, the rest remains in force. We may assign our rights and obligations; you must not assign yours without our consent.
